Terms and Condtions
The following terms and conditions apply to all services offered by Websolve. By ordering services from Websolve you are agreeing to the following terms and conditions-
General
The acceptance of a commission shall be deemed as a contractual agreement between the client and Websolve.
We reserve the right to refuse to construct a website which we may judge as unfit due to content or otherwise. This includes, but is not limited to: sites containing obscene material, sites which promote hatred towards persons belonging to any ethnic group, religion or sexual orientation, and sites which infringe copyright or are contrary to UK laws.
Websolve cannot always guarantee to start work immediately on a commission but will arrange a date with the client as to when work can commence.
Websolve will not commence work until payment has been received from the client and the funds have cleared.
The basic package does not include any promotion of the client’s website what-so-ever. Websolve does not take any responsibility for the promotion, or lack thereof, of the client’s website.
The client’s website will be monitored by Websolve to ensure maximum time online.
All material, both text and images supplied by the client and used in the construction of the client's website, will remain the property of the client. All such material will be assumed to be the property of the client and free to use without fear of breach of copyright laws.
The copyright for all material provided by Websolve, such as HTML code, graphics, photographs and text, will remain the property of Websolve.
Websolve makes every effort to design pages which display acceptably in the most popular current browsers, but cannot accept responsibility for pages which do not display acceptably in new versions of browsers released after pages have been designed.
Domain Names
The initial fee of £289.00 solely covers the design fee and the registration of one .com OR one .co.uk domain name. Other domain suffixes are available on request but may be subject to additional charges.
Websolve is only responsible for the initial registration fee for domain names. As the domain names will be registered in the client’s name, the client is responsible for any subsequent renewal fees. Failure to pay renewal fees may result in the loss of the client’s domain name and therefore loss of their website.
The client will own all rights to their domain name and will remain to do so should they decide to discontinue working with Websolve.
Hosting
Hosting services are subject to a minimum 12 month period.
Billing & Pricing
Any subsequent invoices received by the client, after their initial payment, must be paid within 14 days of issue. Websolve expects payment by cheque, credit card, cash or BACS transfer within 14 days of the date on any invoices.
Websolve reserves the right to alter prices at any time without notice. If a client has commissioned any services from Websolve prior to a change in prices, that commission will not be subject to any increase, but any subsequent commission may be subject to an increase.
Any changes to the client’s website, after it has been signed off by the client, may be subject to separate fees.
Termination of Service
If a client wishes to terminate this contract with Websolve, then the client must provide at least 30 days written notification to:

If at any point during the Website Development Cycle a client wishes to cancel, they may do so, but will be invoiced an amount that Websolve judges to be proportional to the amount of work completed on the commission.
If the client decides to terminate the contract within the first 12 months then Websolve reserve the right to charge the client for the remainder of the contract.
If, during the Website Development Cycle, the client does not supply the content required in order to complete the commission within a reasonable amount of time, Websolve will consider that the client wishes to cancel the commission.
1. Definitions
1.1 In these Terms and Conditions the following meanings apply:
'we', 'our ', 'us' and 'the Company' mean Websolve.
'you' and 'yours' mean the client with whom we make this contract, including any person reasonably appearing to us to act with that client's authority.
'commencement date' means the date set out on the quotation.
'pre-contractual statements' includes pre-contractual statements or agreements, representations, warranties, inducements or promises whether or not made innocently or negligently.
'domain name' means an Internet address that has been registered with the central authorities on the Internet on your behalf.
'web site', 'site' and 'web space' mean the body of work, including text, images, thumbnails, photos and other media, that we develop for you and which is published on the Internet against your domain name.
'host' and 'hosting' mean publishing your web site on the Internet and connecting your name to that site.
'web hit counters' means an Internet connected service that records the number of approaches made to a site.
'down time' means a period of time when any service is unavailable causing loss of access to the Internet by anyone.
ISP means Internet Service Provider.
'intellectual property rights' means any and all patents, trade marks, rights in domain names, rights in designs, copyrights and database rights (whether registered or not and any applications to register or rights to apply for registration of any of the foregoing) rights in confidential information and all other intellectual property rights of a similar or corresponding character which may subsist now or in the future in any part of the world.
'the price' means the sums to be paid by you to us in consideration of the provision of the services.
'the terms of payment' means the terms of payment of the price specified in the quotation
'the quotation' our written statement to you specifying the charge for our services.
'the service' means the design, development, supply of a website, hosting facilities and promotion of the website as specified in the quotation
'the timetable' means the timetable of the provision of the Services as modified from time to time in accordance with the terms of this agreement.
